Appaya Website Terms of Service

§ 1. General provisions

  1. These Terms of Service set out the rules for using the Appaya website available at https://appaya.net/, in particular the rules for using the submission form that enables information concerning an application to be submitted.
  2. These Terms of Service specify, in particular:
    • the types and scope of services provided by electronic means;
    • the rules for using the Website and the Form;
    • the technical requirements necessary to use the Website;
    • the rules for submitting Submissions and Materials;
    • the rules governing the User’s liability for submitted content;
    • the rules for submitting and handling complaints;
    • the rules for terminating use of services provided by electronic means.
  3. These Terms of Service apply solely to use of the Website and the services provided by electronic means through it.
  4. These Terms of Service do not specify the terms of cooperation concerning an application, including, in particular, remuneration, commission, scope of work, rights to the application, the rules for its publication, the parties’ obligations in connection with project implementation, or any other commercial terms.
  5. Any cooperation between Appaya and a person submitting an application may be established on the basis of separate arrangements and a separate agreement.

§ 2. Service Provider

§ 3. Definitions

For the purposes of these Terms of Service, the following terms have the meanings set out below:

  • Appaya or Service Provider – Appaya Sp. z o.o., with its registered office in Warsaw.
  • Website – the Appaya website available at https://appaya.net/, together with its subpages and features.
  • User – any person using the Website.
  • Form – the form available on the Website that enables a Submission to be sent.
  • Submission – information concerning an application sent by the User through the Form.
  • Materials – files and content provided as part of a Submission, including, in particular, descriptions, screenshots and recordings concerning the application.

§ 4. Services provided by electronic means

Through the Website, Appaya provides free-of-charge services by electronic means consisting, in particular, in:

  1. making the Website’s informational content available;
  2. making the Form available;
  3. enabling a Submission to be sent;
  4. enabling Materials to be uploaded;
  5. enabling contact details to be provided for the purpose of handling a Submission;
  6. enabling contact with Appaya.
  1. Use of the basic part of the Website does not require registration or the creation of an account.
  2. Use of the Form does not require the creation of a user account.
  3. The User may use the Website voluntarily and without any limit on the number of Submissions sent.

§ 5. Form and Submission

  1. The Form is intended for presenting Appaya with information concerning an application so that Appaya may review the project and conduct a preliminary assessment of it.
  2. Through the Form, the User may provide, in particular:
    • an email address;
    • the application title;
    • a description of the application;
    • screenshots;
    • a demo recording;
    • information concerning the preferred model.
  3. Sending a Submission requires the information marked as required in the Form to be provided.
  4. The User is required to provide accurate information.
  5. The User should submit only Materials to which they hold the appropriate rights or authorisations permitting their disclosure to Appaya.
  6. The User should not include third-party personal data in the Materials unless its disclosure is necessary to present the application.
  7. If the Materials contain third-party personal data, the User should have an appropriate legal basis for disclosing it.

§ 6. Nature of a Submission

  1. Sending a Submission constitutes submitting an application for a preliminary review and assessment of the project.
  2. Sending a Submission does not constitute the conclusion of an agreement concerning cooperation on the application.
  3. In particular, sending a Submission:
    • does not mean that the application has been accepted for implementation;
    • does not constitute a commitment by Appaya to commence cooperation;
    • does not constitute the conclusion of an agreement concerning the application;
    • does not constitute a commitment by Appaya to publish the application;
    • does not constitute agreement on remuneration, commission or any other commercial terms.
  4. Appaya may assess the Submission and contact the User to obtain additional information.
  5. Any further cooperation requires separate arrangements between the parties.
  6. The detailed terms of such cooperation fall outside the scope of these Terms of Service.

§ 7. Prohibited content and use of the Website

  1. The User is required to use the Website in accordance with the law, these Terms of Service and accepted standards of conduct.
  2. In particular, it is prohibited to:
    • submit unlawful content;
    • submit content that infringes third-party rights;
    • infringe copyright or other intellectual property rights;
    • transmit malware;
    • attempt to gain unauthorised access to the Website, administration panel, database or other Appaya systems;
    • take actions that may disrupt the proper operation of the Website;
    • use the Form for purposes unrelated to its intended purpose;
    • take actions aimed at circumventing the Website’s security measures.
  3. Appaya may refuse to process a Submission or may remove Materials if their storage or further processing is contrary to the law or these Terms of Service, or poses a threat to the security of the Website.

§ 8. Materials submitted by the User

  1. The User is responsible for the legality of the Materials they submit to the extent arising under applicable law.
  2. The mere submission of Materials does not transfer to Appaya any copyright or other rights to the application or the Materials.
  3. These Terms of Service do not constitute a licence agreement concerning the application and do not transfer any rights to the application to Appaya.
  4. Appaya uses the Materials solely to the extent necessary to handle and assess the Submission and in other cases arising under applicable law.

§ 9. Technical requirements

The following are required to use the Website:

  1. a device with Internet access;
  2. an up-to-date web browser;
  3. when using the Form – an active email address;
  4. the ability to upload files in formats supported by the Form.
  1. The User should use up-to-date software and follow basic security practices, in particular by using an up-to-date browser and protecting their device against malware.
  2. Certain Website features may not operate correctly if outdated software or an unusual device configuration is used.

§ 10. Website availability and technical interruptions

  1. Appaya exercises due care to ensure that the Website operates properly and is continuously available.
  2. Appaya may temporarily restrict access to the Website or individual features, in particular in connection with:
    • technical work;
    • maintenance;
    • software updates;
    • a failure;
    • security considerations;
    • causes beyond Appaya’s control.
  3. Where possible, scheduled technical interruptions will be kept to the minimum necessary.

§ 11. Conclusion and termination of the agreement for services provided by electronic means

  1. Services provided by electronic means through the Website are used in accordance with these Terms of Service.
  2. The agreement for the provision by electronic means of the service involving use of the Form is concluded when the User begins using the Form for its intended purpose, after accepting these Terms of Service where such acceptance is required by the Website.
  3. The agreement concerning the sending of a specific Submission is performed when the Submission is correctly sent to Appaya’s system, subject to the continued retention of data and Materials in accordance with the Privacy Policy and applicable law.
  4. The User may stop using the Website at any time.
  5. Appaya may discontinue a specific electronic service where justified by the discontinuation of the relevant Website feature, a change in the Website’s operating model or another legitimate reason, without prejudice to Users’ rights under mandatorily applicable law.

§ 12. Complaints

  1. The User may submit a complaint concerning the operation of the Website or services provided by electronic means.
  2. Complaints may be sent to: studio@appaya.net
  3. Where possible, a complaint should include:
    • a description of the issue;
    • the date on which it occurred;
    • details enabling contact with the User;
    • the User’s preferred resolution of the issue, if any.
  4. Appaya handles complaints without undue delay and no later than 14 days after receipt, unless applicable law provides for a different time limit.
  5. The response to the complaint will be sent to the email address provided by the User.

§ 13. Liability

  1. Appaya is liable for the provision of services in accordance with applicable law.
  2. Appaya is not liable for interruptions in the operation of the Website arising from causes beyond Appaya’s control, including, in particular, failures of telecommunications networks, acts or omissions of infrastructure providers, or other circumstances that Appaya could not have prevented despite exercising due care.
  3. Appaya is not liable for the content of Materials provided by Users.
  4. No provision of these Terms of Service excludes or limits Appaya’s liability to the extent that such exclusion or limitation is prohibited under applicable law.

§ 14. Intellectual property rights

  1. Rights to the Website, its name, designations, materials, texts, graphics, graphic elements and other legally protected elements are held by Appaya or the relevant rights holders.
  2. Use of the Website does not result in the User acquiring any rights to its elements.
  3. Without the rights holder’s consent, it is prohibited to copy, distribute or otherwise use elements of the Website except in cases permitted by law.

§ 15. Personal data

  1. The controller of Users’ personal data is Appaya Sp. z o.o.
  2. Detailed information concerning the processing of personal data is provided in the Privacy and Cookie Policy available on the Website.

§ 16. Amendments to the Terms of Service

Appaya may amend these Terms of Service, in particular in the event of:

  1. changes in the law;
  2. changes in how the Website operates;
  3. the introduction or removal of features;
  4. the need to clarify provisions of these Terms of Service;
  5. changes to the Service Provider’s details.
  1. The current version of these Terms of Service is published on the Website.
  2. Amendments to these Terms of Service do not affect rights acquired by the User before the amendments take effect.

§ 17. Final provisions

  1. Matters not governed by these Terms of Service are subject to Polish law.
  2. If any provision of these Terms of Service is found to be invalid or ineffective, this does not affect the validity of the remaining provisions to the extent permitted by law.
  3. These Terms of Service are made available to the User free of charge in a manner that enables them to be accessed, recorded and reproduced.
  4. These Terms of Service enter into force on 27 August 2026.
